Terms & Conditions

Participants certify that the above Artwork and any accompanying artist statement were made by the student indicated, and were not copied from another photograph, illustration or website, or made by another and do not violate any right of any third party.  

 

Participants hereby grant the Santa Clarita Community College District (“SCCCD”) permission to use photographs or videos of my Artwork in any and all of its publications, including website entries, without payment or any other consideration. Participants grant SCCCD permission to use, reproduce, prepare derivative works, publish, sell, copy, distribute copies to the public, perform publicly, and display publicly the Artwork, any accompanying artist statement, and the student’s name, for all purposes deemed appropriate by SCCCD. SCCCD may distribute the Artwork through a variety of media, including but not limited to print, television, websites, or any other means. SCCCD may also permit a third party to exercise SCCCD’s rights, including but not limited to the right to display or distribute the artwork, in a manner SCCCD deems appropriate. Participants  will be maintain copyright to their images. Participants understand and agree that photographs, art objects, or videos selected for the Student Art Collection become  the property of SCCCD. 

 

Participants hereby irrevocably authorize the SCCCD to edit, alter, copy, exhibit, publish or distribute this photo or video for purposes of publicizing the SCCCD’s programs or for any other lawful purpose. In addition, Participants waive the right to inspect or approve the finished product, including written or electronic copy, wherein my Artwork appears. Additionally, Participants waive any right to royalties or other compensation arising or related to the use of the photograph or video. 

 

Participants hereby agree to hold harmless and indemnify the Santa Clarita Community College District, their parent, affiliates, subsidiaries, authorized representatives, directors, officers, agents and employees against any and all liability for any judgments, awards, expenses, fines, penalties, attorneys' fees, or other claims for damages in connection with any suit, complaint, charge, proceeding or action of any kind alleging a violation of any statutory or regulatory provision or otherwise arising out of the negligent act or willful misconduct by myself, of its duties and responsibilities under this Agreement, unless such performance or nonperformance occurred at the direction of or was caused by District.  This hold harmless and indemnification includes but is not limited to compensatory damages, punitive damages, regulatory fines and penalties, and extra-contractual liability.
